1. Agreement to Terms
By installing or using BrandLift Live Designer ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
BrandLift Live Designer is a product customization application for Shopify stores that enables merchants to offer personalized products to their customers. Our services include live design tools, print file generation, and integrations with print-on-demand providers. Live Designer is the first product in the BrandLift platform.
3. Account Requirements
- You must have an active Shopify store to use our services
- You must be at least 18 years old or the age of majority in your jurisdiction
- You are responsible for maintaining the security of your account
- You must provide accurate and complete information
4. Subscription and Billing
Plans and Pricing
We offer multiple subscription plans with different features and pricing. Current pricing is available on our website and in the Shopify App Store listing.
Free Trial
New users receive a 14-day free trial. No credit card is required to start your trial.
Billing
Subscriptions are billed through Shopify's billing system. You authorize Shopify to charge your payment method for subscription fees and any applicable overage charges.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.
5. Acceptable Use
You agree not to use our services to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Create or distribute offensive, harmful, or illegal content
- Attempt to access systems or data without authorization
- Interfere with or disrupt our services
- Use our services to send spam or unsolicited communications
6. Intellectual Property
Our Content
The App, including its design, features, and code, is owned by BrandLift and protected by intellectual property laws. You may not copy, modify, or distribute our software without permission.
Your Content
You retain ownership of designs, images, and content you create using our tools. You grant us a license to process this content as necessary to provide our services.
Clipart Library
Our clipart library is provided for use with our services only. You may use clipart in products sold through your store but may not redistribute the clipart files themselves.
7. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDLIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
9. Indemnification
You agree to indemnify and hold harmless BrandLift and its affiliates from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.
10. Termination
We may suspend or terminate your access to our services at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use our services ceases immediately.
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the App. Continued use of our services after changes constitutes acceptance of the new terms.
